Smokers are easily able to buy packets of cigarettes that do not have compulsory graphic health warnings, a new survey shows.
An anti-smoking lobby group has found 70 per cent of shops it surveyed are still selling tobacco products with out-of-date text-only health warnings, 16 months after the federal government made graphic pictures compulsory.
They have called on the government to pass laws that would prevent shops stockpiling and selling old products.
"The tobacco companies fought long and hard to delay and downsize the more effective graphic health warnings," said Professor Simon Chapman, from Action on Smoking and Health (ASH).
"Now, by stockpiling the old warnings, they're still delaying giving smokers the full picture about the diseases and disabilities caused by their products."
All tobacco packets manufactured after March 2006 must have pictorial health warnings that alert smokers and potential smokers to diseases and disabilities that tobacco products cause, and how to get help with quitting.
But ASH was able to buy old packets of cigarettes, tobacco or cigars from 28 of the 40 Sydney shops it visited late last month.
All 10 tobacconists surveyed were selling old stock, along with eight of the 10 convenience stores.
Half the supermarkets and petrol stations also had old stock, with less evidence of stockpiling by big supermarket chains and petrol stations with high turnover.
One packet contained no health warning at all and appeared to have been illegally brought into Australia, a spokesman said.
He said the shops may well still be buying the old products from tobacco companies or wholesalers, as current laws only prevented companies from manufacturing packets without picture warnings, not selling them.
"They must have one hell of a stockpile," he said.
ASH chief executive Anne Jones said the government was warned about the dangers of stockpiling but had so far ignored advice that its legislation should include a cut-off date for the sale of old stock.
The lobby group has urged the government to end the stockpiling.
"This is a product that kills nearly 16,000 Australians a year and needs much tougher regulation to protect smokers - and potential smokers, who are mostly children," she said.

Vietnam Tobacco Industry’s (VINATABA) reasons why Vietnam cannot have picture-based pack warnings.

• Most countries in the world are using text-only health warnings, not pictorial ones.
. We are a poor developing country with outdated production technology and uncontrollable cigarette smuggling.
• Printing pictorial health warnings will be costly for the tobacco industry.
• Cigarette package area is quite small. We have to print many other information on the pack, including brand name, name and address of the tobacco company, quantity and quality, date of manufacturing and obey the regulation of stamping on cigarette package. Printing colourful pictorial health warnings will give us difficulties in designing and ar- ranging all the information.
• Our current printing machines are not modern enough to print colourful pictorial health warnings.
• It is estimated that cost for the printing will be 60VND/pack x 2.5 billion packs/year = 150 billion VND/ year. We have no money investing in the printing.
It was the proverbial slip between the cup and the lip for Vietnamese tobacco control as the directives on pack warnings in the Prime Ministerial Instruction were released in May this year.
Vietnam’s Tobacco Control Working Group and activists have long been demanding picture- based, rotational pack warn- ings occupying 50% of the front and back of tobacco packs.
The decision of the Ministry of Health in January this year appeared to be a stepping stone in their journey as it re- quired rotational warnings on 30% of front and back of packs, with the option for pictures.
The decree made room to consider mandatory pictures by 2010.
However, the recent Prime Ministerial Instruction, which superseded the health authority’s decision, undermined the FCTC.
Warnings suggest uncertainly that “Smoking Can Cause Cancer”, with no pictures in sight!
The notion of rotational warnings also seems to have faded away.
This decree mirrors proposals from the Vietnam National Tobacco Corporation (VINATABA).
The Tobacco Corporation proposed the ambiguous, text-only warning, to come into effect after 2008.
Apparently the company contributes about 3% to the total state budget annually.
Obviously, the annual social cost for treatment of three common diseases caused by smok- ing (lung cancer, heart attack and COPD) of 804 billion dongs (US$50.2 million), accounting for 18% of the country’s total health costs, has been overlooked.
Equally ignored are the voices of Vietnamese consumers who were strongly in favour of clear health warnings on tobacco packaging in a survey conducted by Vietnam Standards and Consumers Association in August 2006.
Text-only warnings occupying 30% or 50% pack space were considered ineffective by more than a quarter of the respondents. Notably smokers too showed a similar preference.
Vietnam’s state-regulated media contributed by way of 50 supportive reports on pack warnings in 2006 alone.
The only negative report identified in the local media monitoring was, no doubt, in a tobacco industry magazine.
It is frustrating when the State, the custodian of national welfare, consumer protection and public health, undermines clear con- sumer will and public mandate in exchange for transient gains for industry groups.
Vietnam is a party to the Framework Convention on Tobacco Control (FCTC).
At least 14 other Parties have finalized requirements for picture warnings in keeping with their FCTC commitment and affording basic consumer rights to their citizens.
And many more are in the process of doing so. Vietnam has yet to get it right and the country has only eight months left to live up to the spirit of its FCTC obligation on pack warnings by 17 March 2008.
Will tobacco industry succeed in continuing to deprive Vietnam of picture-based warnings on its tobacco packs?
The international community is closely watching to see if the will of Vietnamese consumers prevails and pictures take their rightful place on their tobacco packs.

The skull and bones symbol is the most easily recognised warning sign. Areas or products with this sign are avoided.
To do otherwise would be to court danger, even death. Then why is the information and broadcasting ministry coy about using the sign on tobacco product packages? In countries where the issue is taken seriously to safeguard public health, graphic health warnings are accompanied by statements like: 'Smoking can cause a slow, painful death' and 'Tobacco smoke can kill babies', covering 40-90 per cent of surface area of the package.
In India, most cigarette packs carry a statutory warning: 'Cigarette Smoking is Injurious to Health'. In fine print, located at the bottom of the face of the packet, the warning, barely visible, is more in the nature of an apology.
Cautionary notices warning cigarette smokers against the ill effects of tobacco are more an obligatory ritual than a serious campaign to deter tobacco users.
That all tobacco products — including cigarettes, bidi and gutka — ought to display the skull and bones sign was recommended by a standing committee of Parliament in the Cigarette and Other Tobacco Products Bill, 2000.
In the wake of growing opposition from tobacco growers, members of Parliament and ministers have become reluctant to support any overt display of deterrent signs on tobacco products. The argument is that such signs would scare consumers away from these products, adversely affecting demand, forcing a million workers out of their jobs.
This, however, need not happen. Tobacco companies, like ITC, for instance, are diversifying to hotels and agro-products, moving away from tobacco, and more jobs are being created in these areas.
Even if it does cause temporary dislocation, that by itself does not make smoking a healthy activity that cannot be discouraged.
Society often has to assert choices in favour of outcomes that enhance the general well-being of people even if there is a temporary cost to bear for certain groups.
Symbols are important in a country like India where literacy rates are low and superstition rides high. Bidi and gutka are consumed largely by the poor, most of who are illiterate.
When developed countries worldwide are moving away from tobacco use, by imposing bans in work and public places and levying heavy fines on violators and vigorously promoting anti-smoking awareness campaigns, why are countries like India and China acting shy?

Egypt is fulfilling one of her treaty obligations under the Framework Convention on Tobacco Control which require state parties to introduce, among other tobacco control measures, large, graphic health warnings on cigarette packs.
The photos below from Egypt's Ministry of Health show a series of four new tobacco warning labels which will appear on packets of cigarettes sold in the country.

Egypt uses stark warnings in anti-smoking campaign

Offering a cigarette is as common as a handshake in Egypt, where the culture of smoking is so entrenched that patients and friends sometimes light up in hospital rooms.
But now, the government is finally getting serious about the health risks, launching a new campaign of stark visual warnings about tobacco's dangers.
Starting Aug. 1, cigarette labels in Egypt will be required to carry images of the effects of smoking: a dying man in an oxygen mask, a coughing child, and a limp cigarette symbolizing impotence.
It's a major step in Egypt's fledgling anti-smoking campaign and a dramatic change in a country where public discussion of smoking's health risks is nearly nonexistent.
"I would like to quit but I just can't. But when you see pictures like this, like that sick man, that has an effect — it does encourage you to stop," said Osama Sabri Mohammed, a 39-year-old civil servant, as he puffed on a cigarette outside a government building in downtown Cairo.
"This one specifically will have an effect on Egyptians, since they are really concerned about that," he said, when shown the image of the limp cigarette.
The photo of the limp cigarette comes with the warning that "long-term smoking has an effect on marital relations" — somewhat coyer than a version the European Union has recommended for its member countries, which states directly that smoking "causes impotence" and shows a discontented young married couple sitting apart in bed.
Twelve countries, including Canada, Jordan, Brazil and Thailand, require graphic photos of the effects of smoking to be printed on cigarette packs — and many have reported success in at least reminding smokers of the danger.
But the campaign faces a tough challenge among Egypt's die-hard smokers.
Egypt is one of the top 15 smoking countries in the world: Nearly 60 percent of all adult males in this country of 79 million people use tobacco in some form, compared to the United States where around 24 percent of men smoke cigarettes. An estimated 2 percent of Egyptian women smoke — though most researchers believe female smoking is greatly underreported due to social taboos against it that push female smoking into private areas.
In Egypt, ashtrays can be found everywhere from elevators to bathrooms. Passing around cigarettes or firing up a shisha, as the waterpipe is called here, is a must at every social occasion.
It's widespread even among those supposed to know better: Nearly a third of male health professionals smoke. In the hallways of the Health Ministry, "no smoking" signs are ubiquitous — as are buckets of sand filled with cigarette butts from smokers ignoring the rule.
"Egypt is an extraordinarily challenging country because it has such a culture of smoking, it's so ingrained in day-to-day living," said Gary Saffitz, the deputy director of Johns Hopkins University Bloomberg School of Public Health's Center for Communication Programs, which is helping Egypt with the campaign.
But, he says, the government appears to have realized the depth of the public health problem "not just in human capacity and lives, but the cost in dealing with all the disease generated by it."
While anti-smoking campaigns have been in place for decades in the West, the issue has not even been on the agenda in Egypt. In the 1990s, when smoking in the developed world declined, it increased 8.6 percent in the Middle East, according to the American Cancer Society.
The first big step came in 2005, when Egypt ratified the World Health Organization's Framework Convention on Tobacco Control, which lays out methods to combat tobacco use, including pictorial warning labels.
Since then, the first baby steps have been taken to ban smoking in some areas. Airports and Cairo's metro are strictly no-smoking, and a 2007 law banned smoking in government buildings — though enforcement is still an issue.
A month ago, the country's new tobacco control department was launched, though it consists of only two people in a closet-sized office with no telephones and an annual budget of just US$12,500.
For the new label requirements, authorities field-tested a variety of images.
They found that warnings linking tobacco with death were not particularly effective with Egyptians, since dying is perceived as inevitable anyway. Also, images of diseased lungs left people confused about what was being shown.
Instead, the new warnings focus on threats to health and, particularly, to family, like the effect on children and pregnant women and the risk of impotence. Numerous studies, including a 2003 report by Tulane University researchers, have found that smoking can be a major cause of erectile disfunction, in part because it constricts veins and arteries, reducing blood flow.
"We need something to give the smokers a shock that they are in great danger," said Dr. Mohammed Mehrez, head of the tobacco control department.
There are many myths to overcome.
Some Egyptians are convinced only light cigarettes lead to impotence. Earlier this year, the state-owned manufacturer Eastern Tobacco Company voluntarily put pictures of diseased lungs on some packs — but smokers just figured those packs were the ones that were harmful and switched to others, which some shopowners promptly started selling at a higher price.
And, as everywhere in the world, many smokers who realize it is bad still show scant interest in quitting.
"I've been smoking since I was eight years old — I used to pick up cigarette butts from the gutter and smoke them," laughed Hussein Hassan Mahmoud, a wizened 60-year-old butcher with one eye clouded from cataracts, sitting outside his Cairo shop enjoying a cigarette.
Mahmoud goes through three or four packs of the local Cleopatra cigarettes a day, at about US 50 cents a pack, and he scoffed when shown the new warnings.
"People will just tear the labels off," he said.

K. Krasovsky1, T. Andreeva2. Since January 2007 provisions of the FCTC Article 11 on packaging and labeling are enacted in Ukraine. However tobacco industry managed to ensure such legislation wording, that while there are no contradictions with the FCTC wording, the impact could be rather poor. Health warnings. By law all packaging and labeling used in the retail sale of tobacco products carry health warnings. These warnings are: Ban of misleading terms. By law in Ukraine it is prohibited to produce and to import tobacco products with the use on their packages terms, descriptors... that can be misleading… including such terms, as “light”. Cigarette packs in Ukraine do not bear any more such words as “lights”. However brand varieties just changed words, for example, “lights” are changed for “blue”. Most brands kept the design and it is easy to distinguish “light” varieties just by color. Some new terms are supported by figure, which is ISO tar level. Emissions information. All packs contain information on emissions of tobacco products as defined by national authorities, but there are just tar and nicotine by ISO method, and from these figures smokers still get erroneous impression about health effects, hazards or emissions. CONCLUSION. The tobacco industry found ways to weaken the FCTC provisions, while giving the impression that it strictly follows them.
